1. Preamble

bluvisio GmbH takes the protection of your personal data very seriously. We handle your personal data confidentially and always compliant with the current data protection laws, as well as this policy.

1.1 Definitions

In regard to the specific terms used in this data privacy policy, we refer to the definitions in the Article 4 of the General Data Protection Regulation (GDPR).

1.2 Security

For security reasons and to securely transfer classified content from you to us as website providers, our website uses an SSL encryption. Therefore, third parties cannot read any data transferred to us via the website. You will recognize an encrypted connection by the “https://…” address line in your internet browser and by the lock-symbol in the browser header.

However, Internet-based data transmissions may in principle have security vulnerabilities, so absolute protection may not be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.

3. Information about the collection of personal data

Below, we inform about the collection of personal data.

3.1 Contacting

Whenever you contact us via email, the transferred data (e.g. your email address, your name, and your telephone number) is automatically stored and processed by us in order to answer your questions. Such voluntarily transferred personal data is processed exclusively for the reasons of request processing or contacting the data subject. The legal basis for these processing operations is Art. 6(1) S1 lit. f GDPR.

3.2 Job applications

If you apply to us for a job, the transferred data (e.g. your email address, your name, and your telephone number, as well as other personal data within the curriculum vitae, the references, the cover letter, and other attached documents) is automatically stored and processed by us in order to process your application. The legal basis for these processing operations of your data is Art. 6(1) S1 lit. f GDPR. If you authorize us to, we may also store and process your personal data after the application procedure to inform you about future job openings. The legal basis for this is Art. 6(1) S1 lit. a GDPR.

3.3 Server-log data

The provider of the website automatically collects and stores information your browser transfers to us. This includes:

  • Internet browser type and internet browser version
  • current operating system
  • website from where you reached our website (so called “referrer URL”)
  • hostname of the accessing computer
  • date and time of the server request
  • time zone difference to Greenwich Mean Time (GMT)
  • IP address
  • subpages accessed on our website
  • access status/HTTP status code
  • amount of transferred data
  • language and version of browser software

This data is not combined with other data sources. Art. 6(1) S1 lit. f GDPR serves as the legal basis for these data processing operations.

3.4 Cookies

Our website uses cookies. Cookies are small text files that are stored in your computer system by your internet browser. Cookies help us to provide the users of our website with more user-friendly services and to make our website more effective and secure.

Some cookies are “session cookies”. These cookies are deleted at the end of your internet browser session. However, other cookies remain on your device until you delete them yourself. These cookies help us to recognize you, when you return to our website.

With a modern internet browser you can monitor, restrict, or prevent the storage of cookies on your device. Many internet browsers can be configured to automatically delete cookies upon closing the application. The deactivation of cookies on your device may result in a limited functionality of our website. The storage of cookies, which are required for certain electronic communication processes or the provision of certain desired functions (e.g. shopping cart in a webshop) is carried out on the legal basis of Art. 6(1) S1 lit. f GDPR. 3.5 ajax.googleapis.com & jQuery

On this website, we use Ajax and jQuery technologies, which provides a faster loading in internet browsers. In that regard, program libraries are called up from Google servers. The CDN (content delivery network) of Google is used. If you used jQuery before on other websites from the Google CDN, your internet browser will access the copy stored in the cache. If this mechanism cannot be used, a download is required. In this case, data from your internet browser is transferred to Google!Inc. („Google”) in the USA. You can access more information about this on the website of the respective provider. Art. 6(1) S1 lit. f GDPR serves as the legal basis for these data processing operations.

3.6 Google Analytics

Soweit Sie Ihre Einwilligung erklärt haben, setzen wir auf dieser Website Google Analytics ein. Dies ist ein Webanalysedienst der Google LLC. Zuständiger Dienstanbieter in der EU ist die Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland („Google“).

Scope of processing
Google Analytics uses cookies that enable an analysis of your use of our website. The information collected by means of the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

We use the User ID feature. The User ID allows us to assign a unique, persistent ID to one or more sessions (and the activities within those sessions) and analyze user behavior across devices.

We use Google Signals. This captures additional information in Google Analytics about users who have enabled personalized ads (interests and demographics) and ads can be delivered to these users in cross-device remarketing campaigns.

We use the anonymizeIP function (so-called IP masking): Due to the activation of IP anonymization on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

During your visit to the website, the following data is collected:

  • the pages you have called up, your “click path“
  • achievement of “website goals” (conversions, e.g. newsletter sign-ups, downloads, purchases)
  • your user behavior (for example, clicks, visit duration, bounce rates)
  • your approximate location (region)
  • your IP address (in shortened form)
  • technical information about your browser and the end devices you use (e.g. language setting, screen resolution)
  • your internet provider
  • the referrer URL (via which website/advertising medium you came to this website)

Processing purposes
On behalf of the operator of this website, Google will use this information for the purpose of evaluating your (pseudonymous) use of the website and composing reports on website activity. The reports provided by Google Analytics are used to analyze the performance of our website and the success of our marketing campaigns.

Recipient
The recipient of the data is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland as a processor. We have concluded an order processing agreement with Google for this purpose. Google LLC, based in California, USA, and, if applicable, US authorities may access the data stored by Google.

Transfer to third countries
A transfer of data to the USA cannot be ruled out.

Storage duration
The data sent by us and linked to cookies are automatically deleted after 14 months. The deletion of data whose retention period has been reached occurs automatically once a month.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by
a. not giving your consent to the cookie setting or
b. downloading and installing the browser add-on to disable Google Analytics here.

Legal basis and option of consent withdrawal
The legal basis for this data processing is your consent, Art. (1) S1 lit. f GDPR. You can withdraw your consent at any time with effect for the future by calling up the cookie settings and changing your selection here.

4. Period for which the personal data will be stored

We process and store your personal data only for the period of time necessary to accomplish the processing purpose or if it is required by law of the European legislator or another legislator that the controller is subject to.

If the processing purpose is omitted or if by law of the European legislator or other applicable legislator the required storage period expires, your personal data will be restricted of processing or erased in accordance to the current applicable law. The criteria used to determine the period of storage of personal data is the respective legitimate retention period. After expiration of that period, the corresponding data is deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

5. Your rights

Below, we inform about your rights regarding your personal data.

5.1 Information, rectification, restriction of processing, erasure

Within the limits of the current applicable law, you shall free of charge and at any time have the right to information about your personal data processed by us, the source of that data, the recipients of that data, the legitimate purpose of the processing, and – if applicable – to rectification, restriction of processing, and erasure of that data. 5.2 Withdrawal of consent

You shall have the right granted by the European legislator to withdraw your consent to processing of your personal data. A withdrawal of an already expressed consent is possible at any time. An informal information via email is sufficient for such a withdrawal. The legitimacy of the data processing until the time of a withdrawal shall remain unaffected.

5.3 Data portability

You shall have the right to receive your personal data, which was processed by us upon your consent or upon fulfillment of a contract, and to transmit that data to another controller. We will provide that data in a machine-readable format. If you request a direct transfer of the personal data to another controller, we shall fulfill that request where it is technically feasible.

5.4 Complaint with the responsible supervising authority

Upon a data privacy protection violation, you shall have the right to file a complaint with the responsible supervising authority. The responsible authority for data privacy protection-related inquiries is the State Data Privacy Protection Officer of the state where our company resides.
